NOT ONLY IS IT IMMORAL, BUT ALSO ILLEGAL ..Under the Soldier and Sailors Relief Act, "No sale, foreclosure or seizure of property ...

 

Under the Soldier and Sailors Relief Act, "No sale, foreclosure or seizure of property ... shall be valid if made during the period of military service." Uh, Wells...this means YOU as well..you are not exempt from federal law, although you are notorious for trying to dance around them.

The sickening part is that the VA had sent the papers verifying military service, and less than a week after they received them, Wells Fargo Mortgage filed for foreclosure. One good thing may come out of this fiasco...WFM may lose business.

Now I am wondering how they knew who I was referring to regarding the foreclosure. I did not provide any names and I did not provide any particular town or state. I did tell them I considered Wells Fargo to be anti American and I had contacted my stock broker to let him know I did not wish to have anything to do with Wells Fargo. I'm still keeping my eye on this one.

Well Fargo mortgage removed $1,050.00 from my escrow for American security group in 2003.I asked them why I was told I needed ins.I had ins with state farm.I gave them a copy of my ins and they returned 958.00 to the escrow.They said I wouldn,t receive all the money back because I didn,t have ins for two weeks.When I proved I had ins for the two weeks they still wouldn,t return the money.ON top of that with in one year my mortgage payments went up and down five times $555.45, $580.01, $788.88,$687.95,and $696.55 with no!!!!.

At the end of 2004 Wells Fargo UPED my mortgage to 855.04 I called and told them I have fix interest rate.They told me I was short in my escrow and if I payed them $1,304.06 they would put my payment at $766.00 so I payed them and my payment stayed at $855.04 so I couldn,t take anymore.I desided to refinance I haven,t even made my first payment to the new mortgage com jest to find out Wells fargo mortgage payed off my the new com and they have my mortgage agein and they already misplaced $162.00 out of my escrow.

Over the last three years Wells Fargo has made my life so hard and I don,t know why .One more thing my taxes and ins are $2,000.00 a year Wells Fargo was tring to get me to pay in $3,600.00 a year to my escrow and the new refinance com didn,t even now why.Can anyone HELP ME?

We were financed with Norwest, bought out by Wells Fargo. The nightmare began. Upon Chapter 13 discharge, Wells Fargo charged that we still owed 4 months payments. Which we didnt. However, our attorney, and they managed to get an additional $1028.78 plus attorney fees out of us. To this day I dont understand how that happened. This extended us an additional year of bankruptcy. Upon completed discharge, Well Fargo again, accused us of four months behind on payments. This time we fought back. At least tried.

Have proof these payments were made. They offer to pay our attorneys fees, which made me nervous. How do these people justify additional moneys that theyre not owed? We have been caught up in litigations with them for a year now. With proof that we made payments. Now they want additional money plus a buffer? Thousands of dollars they want, that we dont have, that we shouldnt have to pay. Every statement from Wells Fargo had a different amount due. Theyve reported to Credit bureau that we're in "foreclosure process". When I ask our attorney about it. He says its best to just pay them what they want. Or go to State court/with another attorney. This is the gest of it. I Pray there's an attorney out there that has the stamina to go up against them. They need to be STOPPED! We just want to make our payments, know we can retire in our home, know that it will stay "our" home. They are predators!

Wells Fargo rejected the payoff of my morgage, demanded more money than the payoff quoted and paid, and costed me an additional wire charge! Recently, I paid off my home morgage. Before wiring funds, I called Wells Fargo TWICE, once to verify the payoff amount and PROCEDURES, and a second time to verify the correct routing number.

As instructed by Wells Fargo, my bank wired the CORRECT amount of money to Wells Fargo, referencing my loan number, AND received a confirmation that the money was received by Wells Fargo (all before the required time of 2 p.m. Central).

A few hours later Well Fargo REJECTED the payoff! Suddenly they claimed that my loan information wasn't enough and that the wire needed to be sent to another account belonging to Wells Fargo! They insisted my bank wire the funds again, and then, and only then, would Wells Fargo ACCEPT MY MONEY AND 'pay off' my loan.

My bank representative immediately sent the wire again (i.e. same day and within minutes of Wells Fargo 'rejection' of my money!). Wells Fargo accepted the wire. However, then Wells Fargo insisted that they needed MORE MONEY now to payoff the loan, or they WOULD refuse to release the documents. In addition, I was charged an additional wire fee from my bank because Wells Fargo rejected the first wire! WHAT A RIPOFF!!! IT'S APPARENTLY THEIR LITTLE WAY OF GETTING AN EXTRA DAY'S INTEREST AT THE EXPENSE OF THEIR CUSTOMERS.

In addition, customer service is extremely poor overall. For example, it is virtually IMPOSSIBLE to speak to a manager or supervisor either in morgages or in their call center! Their people are trained, even when the manager is literally standing right next to them, to keep asking for information and refuse to let you speak to a manager! HORRIBLE SERVICE. AVOID WELLS FARGO MORGAGE!

In December 2003 we recieved a notice from Wells Fargo that we were delinquint on our payments and if not remedied Forclosure would commence. After getting the run around on the telephone for over a month it was found that WElls Fargo had not logged some of the payments we had made. After taking the reciepts to the bank, since all the counter mortgage offices are non-existent in Iowa, we were told that it was okay.

In July we recieved a certified letter that the foreclosure process had started. After contacting the attorney handling the foreclosure and explaining the situation we ended up having a conference call with Wells Fargo and they ended up telling us not to worry about it that we were up to date.

Well along comes Sept. and we end up getting a notice of judgement against us in the foreclosure process by default.

At this point we have been lied to by Wells Fargo and their Attorney Davis and Associates in Des Moines. Well after faxing the reciepts to Wells Fargo again they faxed a letter to us on letter head stating that we were up to date and the matter had been settled. They were supposed to fax the letter to the attorney as well but the attorney would not verify that. We even have a letter from Polk Count Court that the matter had been settled.

Now on Dec. 15 I see our house listed in the Sheriff's notice of foreclosures in the paper and it is set for Jan. 20, 2005.

I contacted Wells Fargo againand they deny sending any letter and also state that we have not made payment since Sept. 2003. After telling them that we had been making payments for all the months in question the lady on the phone said "Well even if you were making payments we would have sent them all back since it is in foreclosure". I asked if there was an office I could go to take the payment reciepts to straighten out the mess she checked and came back on the line and said " We do not do over the counter business in Des Moines"

Now they do not know what happened to the payments and I am on the verge of losing my home even though I have reciepts, a letter from Wells Fargo, of which they said the lady dosent even work in the mortgage department, and I cant even talk to the same operator on the phone as it is not there policy to give out their extension for that reason. I am at the point of where the stress is too much and I am going to let them take the home as I am in the process of starting a lawsuit against them.

Wells Fargo is the most impersonal company and distrusting company I have ever dealt with. I have all the reciepts but due to their inability to do their part on the business end I am screwed. Even the courts did not believe me as if I fabricated the reciepts on my own.

Does anyone else want to sue them too?

Got a call from Wells Fargo's collection folks last night claiming we owed $170.00 in late fees for our August mortgage payment. Apparently, (awaiting copy of check from our bank to see if it was our error or their's) we made the check out for $X,001.34 instead of $X,4001.34 in error. The check was deposited by Wells on July 20, 10 days prior to the due date, but the rep claimed that they can't apply partial payments to our account and therefor had to assess the full late fee. I asked why it was they didn't contact us when they received the check and of course she said she was sorry but didn't know why the processing department didn't do so.

I noted how they were able to contact us only 4 days after the 15 day grace period yet unable to do so to advise us of an obvious error. Clearly they are waiting for the grace period to expire then are trying to assess a 5% late fee on the full amount. Undoubtedly this is happening to thousands of their customers who make an honest mistake. I have contacted a law firm and will be pursuing whatever type of legal action I can to strike back at these unscrupulous ba*tards. I will also be refinancing my home immediately to avoid dealing with them in the future.

where do i begin? my insurance agent of 20 years retired & forwarded client files to a new agency; new agency "forgot" about the file; did not secure new coverage; old policy lapsed 5/9/98, cost was $325.00/yr. Norwest informed me of lender placed ins coverage, really horrible coverage; cost $1,472 property + $226 contents--total $1,698/yr..but coverage substantially less!!!!!!!.....their binder letter dated 6/21/98; received 6/30/98.....called new ins agent to remind him he forgot to place new coverage.......wouldn't you just guess? .......lightening strike on property 7/7/98......entered thru plumbing system...not all that bad of damage.....norwest sent adjustor......he informed us it was a fluke...no lightening strike on property (but power line in front yard severed in two @ same time as hot water heater blew up/leaked in basement/a/d unit went dead.....told adjustor that water appliances not working properly....he said "imagination." we had just married...had 2 washers/dryers....one set just sitting in basement, unhooked. rethought water appliances, wondered if we jumped the gun. ..so.....we made claim for flood damage & h20 heater/a/c unit, etc. Agent also informed us that we had better not change our coverage until the claim was settled in full, or company would not pay damages....coverage price much more....but we let it go..received norwest's affiliate adjustor's claim amts...all worng, missing so much,....etc. then, . 8/20/98: washer got stuck on fill cycle, we were out, serious flooding of basement, serious personal property damage. contacted plumber...he said adjustor knew that most common way for lightening to enter a home is thru plumbing. told us that it was criminal that adjustor did not tell us to have all water appliances checked for damage, so further problems/floods could be avoided......ok, so we're just screwed.

if that is not enough.........insurer sent at least 2 checks to norwest mtg, total of around $7,300; we could not contact ins co; norwest denied receiving any funds. asked for nearly a year.....claim stuck in limbo........finally convinced norwest/wells fargo to fax account statement....found out about insurance funds....and ins co finally acknowledged that other monies were forwarded to norwest, also.......tried to coax norwest into acknowledging funds kept for the year...got told it was not our money, sue us, too bad, money not there...don't know what you are looking at...not on my printout......look again, etc., etc.,........loan got behind, norwest claimed in default....still tried to argue that funds sitting there, unacknowledged....was told that i had not been entitled to the account printout in the first place, so i could not discuss it with mtg co....confidential info..why is my mortgage confidential from me? up until 2 days prior to foreclosure, norwest denied funds present, even though i faxed them proof that i knew the funds were on hand...note clearly states that any such proceeds were to be credited to default....this was not done....norwest told me it did not matter what my note agreement said....it was just paper, as far as they were concerned....got an offer to purchase on home...contacted norwest in an effort to avioid foreclosure..had funds available for immediate payoff.....requested payoff figures for note.....got figures from norwest of nearly $16,000 more than my calculations... begged them to recheck...told them the sale would not transpire due to figures......informed them that in event of total payoff, funds should be credited...please, let us avoid foreclosure.....norwest told us that we should have kept the loan current......now it's fair game.....we lose......tried everything...no avail. note: the calculations i referred to did not even include theninsurance monies on hand......should have been $ in my favor at time of sale, even though we agreed to sell property at less than market value, just to avoid foreclosure, which terrified us....what happened? norwest foreclosed......sold the property on courthouse steps for a different amount than payoff figure quoted us.......! now we go to state court....probably sue for punitive damages.

moral of this story: forget about norwest mortgage/wells fargo mortgage........looks good, until they screw you! if you contract with them, please! please! keep close track of your account; demand quarterly account summaries, in writing, and let them know that if anything is out, you will use all rights and remedies in your power to effect a resolution.........and, if they do not cooperate, let them know that punitive damages are around the corner.

beware! never thought that mortgage companies were scam artists! criminal! now i know better.

trying to have sale recinded (mortgage lender purchased property back)......guess i am going to file suit for fraud, misconduct, conspiracy, mail fraud, etc., etc., etc. but all we ever wanted was to stay in our home, which my husband has occupied for some 17 years.

In 1996 I purchased a duplex in Anchorage, Alaska through a local mortgage company called City Mortgage for $208,000.00. I was to receive a fixed rate FHA mortgage at 6.75% APR. The transaction was supposed to close in December 1 of 1995, but it didn't actually close until January 3, 1996. Because of the freezing weather that winter we took early occupancy on December 15th 1995.



At the closing, while signing all the many documents, I discovered that the loan I was getting was not a FIXED RATE but rather an ADJUSTIBLE RATE mortgage. After an hour of discussions with the mortgage company, they said that I could convert the loan in a year to a fixed rate with no charges for the service. I agreed and signed and closed.

Soon thereafter, the mortgage was sold to Norwest Mortgage. When I inquired a year later about converting my loan Norwest Mortgage told that there would be a large fee to convert the loan, more money than I could afford.

By the third year into the loan I was having difficulty making the payments. I had had a tenant that was not able to pay her rent and I had to evict her. There was several thousand dollars of damage that I inherited along with several months of lost rent before and after I was able to evict her.

My loan ended up in default and I eventually was able to gather enough money to bring it back out of foreclosure. This cost me in excess of $15,000.00. My monthly payments started at $1,683.00 per month, and by the third year they were up to $1,895.00.

By the end of the forth year I had applied for a loan modification to have the interest rate somewhat lowered and fixed. I was now at almost 10% APR. Norwest was going to lower my interest rate to 9% and fix it at that rate. This was supposed to lower my payment back down by $100.00 a month. This whole process only cost me an additional $2,010.00 in fees, of which I sent them a check.

The very day that I received notification that I had been APPROVED for this loan modification, a process server was at my front door tacking up a notice of public auction. This indicated to me that somewhere within the Norwest Mortgage system something was definitely wrong.

By now I have exhausted all of my financial resources and could not afford to buy myself back out of foreclosure a second time. In 2000, I filed bankruptcy and my $200,000.00 duplex went into foreclosure. I literally lost everything except a small amount of furniture, my personal effects, a 5th wheel trailer and a truck. My credit is totally shot. I am homeless.

I have now become a real estate broker and have learned a lot about how this system really works. It has taken me the last 4 years to finally get back on my feet. I live in my 5th wheel in the summer and in my office, that I rent, in the winter. I have to borrow a shower in the winter because my office only has a sink and toilet. I cook on a 2-burner hot plate and a toaster oven.

I still have several years to go before all of these credit issues will be off of my credit report so that I can buy a home.

The amount of anguish and stress that I have gone through has been overwhelming. I am a good person and have never tried to cheat anyone out of anything. I do not think this was a fair treatment of even ethical. I was lied to and cheated out of my home and over $20,000.00 in equity, not to mention my credit rating.

If there is a class action suit ongoing with these guys, I would appreciate hearing about it.

I have taken advantage of Wells Fargo Mortgage Enhancement Program. How this works is you pay 1/2 your mortgage every two weeks instead of one payment a month. You make an extra payment a year that is directly applied to your principal; therefore you pay off your loan faster. Good deal, right?

Well, what Wells Fargo does not tell you is they "farm out" this service to a subsidiary that charges $4.00 a transaction, or $8.00 a month.

My problem with this is I was NOT informed of this when signing up for the program. WF did not inform me that another company would be handling my payments. A company that I did not know about has access to my checking acct. BIG PROBLEM

I am on a VERY tight budget now and I am trying to save all the money I can. When I called WF to ask if I can just set up through online banking to send in bi-weekly payments myself, I was quickly informed that when the whole pymt. is not sent in that funds are put into a suspense acct. So you are forced to pay $8.00 a month for bi-weekly pymts. A RIP-OFF

We got a mortgage from Wells Fargo Mortgage at 9%+ due to our credit being fair with some spots. We got a 2nd mortgage right after to remodel the basement and put in a new bathroom and finish off the master bedroom suite.

The bathroom cost more and my husband talked to Tara and she combined the first and second into one and she was so happy because she saved us ALOT of money.

After we signed the papers and got our first statement we found out that it was a 15 year loan not a 30 and that she had INCREASED the percent rate from the 9%+ that we were paying to over 10%.

When my husband talked to her about this she told him that they could only do 15 year mortgages. She had asked us how much we could afford for payments and we told her what our first mortgage payment was and what our second mortgage payment was which added up to a little over 1200 bucks a month.

We did not want to go any higher than that. We were very shocked when the payment was $1895 a month. The first mortgage had a 2 year penalty if we paid the loan off before that.

When Tara combined the two they charged us over 12,000 dollars in fees and even though it was through another Wells Fargo account we were never told we would be charged that amount.

We had made a couple of payments on both the mortgages so we were current on them. I was shocked that the interest rate was increased.

I started checking around to see if we could get someone to give us a better rate and a 30 year loan. Well come to find out that when a couple of these other mortgages companies checked our credit they backed off.

It wasn't until we talked to Jeremy at United that we found out that Wells Fargo had reported on our credit report that we had a 311,000 mortgage with them.

They were reporting the principal plus the interest for the 30 year loan. Jeremy worked with us and finally found out what was going on and when we got serious about going with United and Jeremy started calling Tara for payoff figures she refused to talk to anyone from United.

They avoided giving the information and then Tara called to find out what was going on and my husband told her we were refinancing to get a better rate.

She lied repreatedly about faxing or sending the payoff figures to Jeremy and now it is March 3 and she left a voice mail message that were SERIOUSLY delinguent on our mortgage and they were starting foreclosure proceedings against us because January's payment wasn't made due to the delay in getting the payoff information to United.

A date was given for closing and was cancelled several times due to the non-cooperation from Tara and Wells Fargo people in general.

The one question we asked of Tara was should we make the January payment and Jeremy was told that with the closing so close we didn't need to make that payment. Well the closing date got canceled because Jeremy needed more information from them and when the first payoff figure came out they only guaranteed that payoff for a week not 20-30 days.

We were constantly asking if we should make the January payment and we were told we should be closing within the week.

The cooperation for payoff figures and dates were a HUGE hassle. The last date we were scheduled to close was the 22nd of February and it as ususal it was cancelled.

We finished signing the papers on 3/2/03. My husband had to make a payment because the February payment was due 2/24.

Tara told my husband that were grossly delinquent on the mortgage even though the February payment was still within the grace period.

The funds will finally be transferred this week 3/5 to get rid of Wells Fargo. I am going to be checking our credit report to see if they have reported our mortgage as in foreclosure.

We also have a car loan with Tara that was refinanced to pay off some bills and that loan also had the interest rate increased even though I was paid way ahead of time on this loan.

The interest rates on both loans should have gone down not up. I am in the process right now of having Jeremy pull all the information, contacts and whatever else is pertinent to this hassle and I'm going to give this information to our Attorney General's office for review and hopefully starting a lawsuite against Wells Fargo. This has been a HUGE NIGHTMARE.

I never expected Wells Fargo to be such a greedy predator for people like us who are credit impaired. It is not fair because they've made off with well over $20,000 in fees and closing costs. They are worse than loan sharks.

I just returned from the most unrealistic nightmare of court that you can ever imagine. When Wells Fargo Home Mortgages replaced Brenton mortgages in March of 2001 we were instantlt doomed.

We had been with Brenton since 1998. Had been completely satisfied with the service we were recieving.
The minute Wells Fargo took over they changed our payment amount without notice. When they recieved our March payment in the amount of $369.08(the same as stated in our loan agreement)

They rerturned it with the explanation the payment was not the total amount due. When we phoned customer service we were bounced from person to person for over an hour. When I finally got ahold of someone who would listen they told me that I was not on my own mrtgage. and they could not discuss it with me. The representative then hung up. This more than upset me to say the least.

So I dug out my copy of the original mortgage and drove with the payment to our local office here in Davenport,Iowa. After the teller confirmed that I was on the mortgage I asked for reasoning behind the payment being sent back. I was told I would have to call there San Bernadino, California office. When I asked for the number I was told to call the 800 number and ask for someone in that office. As I did this I was once again bounced from person to person for several hours. No resolution was ever given however I was told that someone would get back to me. I waited24 hours and phoned back.

I was told there was a noter on the account and someone would be getting in touch shortly. It took three weeks and a letter to get someone to call me. Then I was told to resubmit the paymemt because it was an error easily taken care of. I then sent 2 months payment since the next was due shortly. BOTH payments were returned with the same explanation. This process was unbelievable. They then began telling me I had to make arrangements towards the account arearages.

I was told I was several (5) months behind at this point. All hell has broken loose since that date. Payments have not been accepted and Wells Fargo gives to many different answers to type. They took $1000.00 from me in September 2001 and said that everything had been taken care of. Then in November they cashed my payment check in the amount of $400.00(trying to be on the safe side I paid a few dollars more)and never posted it.

To this day even with the cancelled check they claim thay never recieved the monies. They then pressed for Foreclosure. I hired an attorney and he got no information from Wells Fargo. I went to a local help agency and had a volunteer asttorney try to get information he got nowhere as well.

In court the claims were not denied that by an employee that Wells Fargo did not ahndle any aspect of our loan properly. However that means NOTHING. I was told by the judge they have a right to change the payment at random. When they changed my amouont they should have sent a notice however that was explained as a minor technicality.

Even thought I have documents upon documents showing the problem was on Wells Farfgo's end I was told there was notjing the jjudge could do.I was then told to pay almost $20,000.00 more than I had borrowed in 1998 to Wells Fargo or relinguish rights to the home. MOst of the money is for fees that are unexplained and others that could have been avoided if Wells Fargo had hired caring and intelligent people as well as implimenting better customer service techniques.

Initial mortgage loan acquired through Prudential in 1194, sold to Norwest, sold to Wells Fargo. Never, ever a problem with Prudential or Norwest but then.... Wells Fargo.

I almost always make an additional prinicipal payment when I make my regular monthly payment - Prudential and Norwest always reduced my principal by the extra payment. I discover in March 2001 that Wells Fargo wasn't reducing my prinicipal and I also discover that my additional prinicipal payments disappeared - and I mean disappeared.

I started writing letters, every single month, and Wells Fargo never responded to any of my correspondence. I make telephone calls and each time I was told someone would return my calls. No one ever did. Even one customer service person told me that I had never made an extra principal payment - that's what he said when looking at my account on the computer. However, I have all called checks and I can prove that not to be true.

I hired an attorney in August 2001, since I wasn't getting anyway, and had a demand letter, under RESPA, made to WF about all my additional principal payments. They never responded to that letter, either. Can't believe it, but it's true. Oh, it gets worse.

From August 2001 on, after the attorney demand letter, I never received another monthly statement from WF. I continued to make my monthly house payments even tho I did not have a statement, every payment on time - now, with return receipt to make sure they rec'd them - and I also wrote letters every month now asking why they were not sending me statements. Never rec'd an answer.

Wrote a 4-page complaint letter to the OCC and just rec'd a response from WF to that letter - they did not answer any of the 12 issues outlined in my letter and stated they had the right to take my money due to "corporate advance fees." I did refinance my house about 6 weeks go (Oh - go to PriceLineMortgage.com - they are fantastic!) and in paying off the loan with WF - all kinds of additional charges were added on - which I just rolled my eyes and told my new escrow to pay so I could go through with the new loan (love it).

With WF response letter, they mailed me a check for $207 -(1) I never would have rec'd that measley amount if not for my letter to the OCC, and (2) they still owe me thousands. Also, in refinancing, I found that WF had reported me as 5 months LATE in my mortgage payments - you've never seen a person bounce off the walls like I did when I heard that - I've never been late, except for a couple of weeks, ONE TIME in all the time I had the loan from 94 on. Well, along w/the response from WF, I rec'd a letter retracting the 5 months and stating that "loan payments were never late."

Well, it's too late - and that negative credit reporting was on my credit report for god knows how long. It was malicious, and criminal. Well, you've heard a few of the 12 legitimate, clear & distinct problems I have had with WF. I'm not even going to go on to the others as if you made it this far, you're tired of reading and I'm tired of writing! But, guess what... this is not the end, only the beginning.

You and they have NOT heard the last from me. The ball is in my court now and I'm ready to play! They think taking my money, credit reporting, never responding to me, etc. is their right, well, mine is a JURY and I can't wait to see my name VERSUS WELLS FARGO and having a jury hear it all - I can't wait! I mean, I can't wait!

Wells Fargo Mortgage formerly Norwest is now called WELLS FARGO

Haven't had any big problems with Wells Fargo (formerly Wells Fargo Mortgage formerly Norwest). BUT they recently stopped returning checks sent to them as payment. Besides being monumentally annoying to a customer used to getting canceled checks returned, there is the potential risk of customers not being able to prove satisfactory payment in case of a dispute with Wells Fargo. Perhaps that factored into their decision!

Obviously, Wells Fargo is trying to save money. BUT, wasn't the cost of returning canceled checks factored into the many fees imposed and collected by the lender? Shouldn't customers who had been getting their checks back be grandfathered out of this new policy? After all, we paid for those pieces of paper. AND we customers will now have to pay for the cost of photocopying payment checks BEFORE mailing them if we want to retain proof of payment! Why not give new customers a choice, for a fee, if it's SO prohibitively expensive?

I've been putting off refinancing but now I will do it and look for a lender who will return my checks!
